Mobile Shops selling food must comply with the requirements set out in the Food Act 2014.

Registration:

The Food Act 2014 applies to all food businesses, including commercial food stall holders and mobile food businesses. Your food business must have a current certificate of registration under the Food Act 2014.

All mobile food vendors residing in the Central Hawke's Bay District must be registered by the council and comply with the relevant regulations and bylaws.

To find the right plan or programme to use, complete the Food Safety Rules tool through MPI.

An initial inspection of the mobile shop and meeting can be arranged with the Environmental Health Officer at your request, this way the Environmental Health Officer can answer any questions you may have. A meeting provides an opportunity to go over any registration requirements.

If you are going to be trading outside of the Central Hawke's Bay District you will need to find a third party verifier. You can find different verifier details here. When trading out of the district you are registered in you will need to contact the Council that you are going to be trading in and find out their riles and what permits are needed.

  1. Trading may not be carried out within Business Zone 1 (Waipukurau and Waipawa) as defined in the District Plan.
  2. No stand-alone mobile shop, stall or hawker shall be permitted to operate within 200 meters of the nearest fixed premises selling the same or like products.
  3. No stand-alone mobile shop, stall or hawker shall be permitted to operate out of a council owned park, reserve or off road car park.
  4. General hours of operation should fall between 9.00am to 6.00pm, 7 day per week.
  5. Signage for the mobile shop shall comply as per the requirements of the District Plan.
