Boundary Dispensation Consent

What is a boundary dispensation?

A boundary dispensation allows you to build or plant trees closer to your boundary than the Central Hawke's Bay District Plan allows. When do I require a boundary dispensation?

Rural Zone:
  • When a dwelling is proposed to be built within 5 metres of a boundary.
  • When an accessory building (including stockyards, and stock loading ramps or races) is proposed to be built within 10 metres of a side boundary, or 20 metres of a road boundary.
Residential Zone:
  • When a dwelling is proposed to be built within 3 metres of a road boundary.
  • When any building is proposed to be built within 1.5 metres of an internal boundary.
  • When an accessory building is proposed to be built within 5 metres of the road boundary and/or in front of the principle building.
Township Zone:
  • When a dwelling is proposed to be built within 3 metres of a road boundary.
  • When any building is proposed to be built within 1.5 metres of an internal boundary.
  • When an accessory building is proposed to be built within 5 metres of the road boundary and/or in front of the principle building.

How do I apply?

A Resource Consent Application Form for Boundary Dispensation is available to view and download here and an Affected Persons Form is also available to view and download here.  The forms are also available from the Waipukurau Library and Service Centre in Kitchener Street, Waipukurau or the main Council Office at 32 Ruataniwha Street, Waipawa. You may also phone Council on +64 6 857 7731 or email the Building Control Administrator and request that the forms be posted to you.

What we need from you

When you have completed the Boundary Dispensation Consent Application Form you need to approach affected neighbours and have them fill in their details etc on the Consent Application Form, on the Affected Persons Form and on a copy of the relevant plans. Once you have all of this forward it along with the fee to Council either by dropping it into our Waipukurau or Waipawa office or post it to:

The process

Send in a Boundary Dispensation Consent Application Form (also include an Affected Persons Form) and plans signed by the affected neighbours - with the appropriate fee. Once received, the documents will be processed by a Planner and signed off by the Regulatory Manager.

How long will it take?

You will be notified of the result of your application within twenty working days of receipt of the full application and $350 fee.
